This website is operated by Productive Babe Club. These Terms and Conditions ("Terms") provide comprehensive guidelines for your engagement with our online community and the purchase of our merchandise ("Products") listed on our website, productivebabeclub.com. Throughout the site, the terms “we”, “us” and “our” refer to Productive Babe Club. Carefully read these terms before ordering any Products, as your acceptance of these terms is a prerequisite for making a purchase.

By visiting our site and/or purchasing from us, you engage in our “Service” and agree to be bound by the following terms and conditions, including additional terms and policies referenced herein and/or available by hyperlink. These Terms and Conditions apply to all users of the site, including users who are browsers, vendors, customers, merchants, and/or contributors of content. If you decline to accept these terms and conditions, you will be unable to order any Products from our site.

General Conditions

We reserve the right to refuse service to anyone for any reason at any time. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

Your status

By placing an order through our site, you confirm that:

• You are legally capable of entering into binding contracts.
• You are at least 18 years old.

How the contract is formed between you and us

Upon placing an order, you will receive an email acknowledging the receipt of your order. This acknowledgment does not signify acceptance. Your order represents an offer to purchase a Product, subject to acceptance by us. The Contract is formed when we dispatch the Product and send you a Dispatch Confirmation.

The Contract is applicable only to those Products confirmed in the Dispatch Confirmation. We are not obligated to supply any other Products until their dispatch is confirmed separately.

Consumer rights

As a consumer, you have the right to cancel your order at anytime before dispatch. You may also request a refund or exchange within 30 days of your purchase but is dependent on the condition of the item. For the full details regarding this, refer to Returns & Refunds policy.

To cancel an order, please inform us via email at theproductivebabeclub@gmail.com with the subject line "cancellation of order," providing the relevant receipt or order confirmation and delivery address. Return the Product(s) within 14 days of notifying us, in the same condition received, at your own cost.

This provision does not impact your statutory rights.

Availability and Delivery

We aim to fulfill your order by the specified delivery date in the Dispatch Confirmation or within 30 days if not specified, except in exceptional circumstances. Our site is regularly updated for stock availability. In case of any issues with the availability of a product marked 'In Stock,' we will promptly communicate with you.

Risk and Title

The risk of loss or damage to Products transfers to you upon delivery. Ownership of the Products passes to you only when we receive full payment, including delivery charges.

Price and Payment

Prices are as quoted on our site, subject to occasional changes. We verify prices during dispatch. We reserve the right to rectify errors and charge the correct price.

Payment for Products must be made in UK Pounds (£) Sterling via credit or debit card. We accept most major credit cards for online orders. You will be asked to enter your card details and the name and address of the card holder when you place the order.  Your card will be debited straight away and your order posted out to you as soon as possible. We take online security extremely seriously and have taken several steps to ensure that your payment information is processed confidentiality and accurately. 

Refunds Policy

Refunds will be processed promptly. For orders cancelled prior to dispatch, we refund the Product price in full, as soon as possible. We examine returned Products and notify you of your refund status within a reasonable period.

Our Liability

We guarantee that Products are of satisfactory quality and reasonably fit for their intended purposes. Our liability is limited to the purchase price and foreseeable losses. We are not liable for indirect losses.

Written Communications

When using our site, you accept that communication will be mainly electronic. We will contact you by email or post notices on our website.

Events Outside Our Control

We are not liable for failure or delay due to events beyond our reasonable control (Force Majeure Event). A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control. This includes, but is not limited to, strikes, natural disasters, and government regulations.

Our performance is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will work hard to find a solution by which our obligations to you as our customer may be performed.

Entire Agreement

These terms and conditions, along with any document expressly referred to in them, constitute the entire agreement between us, superseding any previous arrangement, understanding, or agreement relating to the subject matter of any Contract. Both parties acknowledge that, in entering into a Contract, neither relies on any representation other than as expressly set out in these terms.

This clause does not limit or exclude liability for fraud.

Right to Vary

We reserve the right to revise and amend these terms from time to time. Changes apply to existing orders unless legally required or notified otherwise within seven working days.

Law and Jurisdiction

The purchase of Products through our site and any dispute or claim arising out of or in connection with them will be governed by English law. Any dispute or claim shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.
